[APRRN] Statement of concern on the detention of refugees and asylum seekers of Pakistani origin in Thailand

지난 12월 15일(수) 태국 방콕에서 86명의 파키스탄 난민과 난민신청자들이 태국 당국에 의해 체포되는 일이 있었습니다. 이들은 파키스탄의 이슬람 소수 종파인 아흐마디파로써 대부분 UNHCR에 의해 인정된 난민과 난민신청자들로 불법적인 본국 송환이 우려되고 있는 상황입니다.
이에 APRRN은 네트워크 차원에서 긴급성명을 준비하였고, 이를 태국 당국에 전달 할 예정입니다. APRRN의 22개 단체가 연명 한 가운데 난민인권센터(NANCEN)도 이 긴급성명에 동참하였습니다. 아래에 성명서 전문과 번역본을 올립니다.

Statement of concern on the detention of refugees and asylum seekers of Pakistani origin in Thailand

We, the undersigned, are deeply concerned and shocked at the arrest and detention of 86 refugees and asylum seekers of Pakistani origin in Bangkok. These vulnerable people were arrested from their homes in a dawn raid and taken to the Bangkok Detention centre.

We have information that indicates that almost all the detainees have either been recognized as refugees by the UNHCR or have registration documents as their cases for Refugee Status Determination is under way.  They all belong to the Ahmadiyya faith.  The persecution of Ahmadis has been particularly severe and systematic in Pakistan, which is the only state to have officially declared the Ahmadis to be non-Muslims and are persecuted for professing their religion. The systematic persecution of the community in Pakistan is well documented.

 

This targeted detention by Thai officials of a particular community from their homes is particularly concerning and disturbing.

We have been informed that the detainees include more than 30 children who have been detained along with their parents.

Thailand has been generous and accommodating of those who have sought refuge within its borders. It has been compassionate and understanding of those in need of protection from persecution. These detentions however are a blot on the tolerant and compassionate image of Thailand.

Thailand is the chair of the Human Rights Commission, and it is highly unbecoming of the chair of the Human Rights Commission to sanction a flagrant violation of basic human rights. International human rights standards prohibit arbitrary, indefinite and non-reviewable detention.  Refugees and asylum seekers should not be detained or penalized because they were compelled to enter a country irregularly or without proper documentation.

In addition, Thailand, who has signed the Convention of the Rights of the Child, must ensure the best interest of all children are protected and that they are not detained for migration-related purposes in the first instance.

 

These refugees and asylum seekers are NOT criminals, they need to be protected not hounded like animals.

We strongly urge the Thai government to reconsider its ill advised action and release the 86 detainees.

We hope the Thai government will adhere to the high standards of compassion and human rights through the unconditional release of the detainees.

성명서 : 태국 내 파키스탄 난민들과 난민신청자들의 구금에 대한 우려

이 글에 서명한 우리는 방콕에서 일어난 86명의 난민들과 난민신청자들에 대한 체포 및 구금에 경악을 금치 못하며 심히 염려하는 바이다. 이 피해자들은 새벽에 이뤄진 급습으로 인해 그들의 집에서 체포되어 방콕외국인구금센터(Bangkok Detention Centre)로 이송되었다.

 

우리는 구금자들의 거의 대부분이 UNHCR에 의하여 난민으로 인정받거나 난민신청절차 중에 있다는 증빙서류를 가지고 있다는 정보를 입후한 바 있다. 그들은 모두 아흐마디(Ahmadiyya) 종파의 이슬람교도들이다. 이들의 고국인 파키스탄은 아흐마디 신자들을 무슬림으로 인정하지 않는 유일한 나라이며 그들이 그들의 종교를 고백하면 현저하게 심각하고 구조적인 박해에 노출된다. 파키스탄의 이들 집단에 대한 구조적인 박해는 각종 보고서 등의 문헌 상으로도 밝혀진 바 있다.

 

태국 당국의 특정한 집단을 목표로 자택에서 이루어진 이번 체포 및 구금은 매우 염려되고 우려를 금치 못할 일이다. 또한 우리는 구금자들 가운데 30명 이상의 아이들이 부모와 함께 구금되어 있다는 것을 알게 되었다.

태국은 국경 내에서 난민을 신청한 사람들에 대하여 관대하며 편의를 도모해왔고 박해로부터의 보호를 필요로 하는 이들에 대하여 동정심과 이해심을 가지고 있었다. 그러나 이번 구금은 태국의 관용적이고 동정적인 이미지에 대한 오명으로 기록될 것이다.

태국은 UN Human Rights Council의 의장이지만 기본 인권에 대한 극악한 침해를 제재하지 못하고 있다. 구금에 대한 국제 기준은 고의적, 무기한적 그리고 재심이 불가능한(non-reviewable) 구금을 허용하지 않고 있다. 난민들과 난민신청자들은 그들이 한 나라에 불법적으로 또는 적정한 서류 없이 입국할 수 밖에 없었다고 하여 구금되거나 벌을 받을 수 없다.

게다가 아동권리협약(Convention on the Rights of the Child)에 서명한 태국은 모든 어린이들에 대한 최고의 대우를 제공해야 하며 최초에 이민 관련 목적으로 인해 구금될 수 없으며 보호되어야 한다.

 

이 난민들과 난민 신청자들은 절대로 범죄자들이 아니므로 보호받아야 하고 고통 받으면 안 된다.

따라서 우리는 태국 정부가 제대로 조언 받지 못한 행동을 재고하고 86명의 구금자들을 석방하기를 강력히 촉구한다. 우리는 부디 태국 정부가 구금자들에 대한 무조건적 석방을 통해 가장 높은 인권과 동정의 기준에 맞는 행동을 .행하기를 기대한다.
