인도적 체류 난민의 삶의 권리를 보장하라

 

“창살 없는 감옥에 갇힌 느낌이다.” 2018년 어느 난민환영행사에서 한 인도적체류자가 했던 발언이다.

인도적 체류 난민들은 난민법에 따라 본국으로 돌아갈 수 없는 사정을 인정받았지만, 한국에서 인간답게 살 권리는 보장받지 못하고 있다.

 

인간이라면 마땅히 누려야 할 권리들에서 배제된 채, 이들의 삶은 기본적인 사회적 욕구의 박탈과 미래에 대한 불확실성으로 점철되어 있다. 그리고 그 박탈과 불확실성은 시간이 흐르며 이제 부모 세대에서 자녀 세대로 이어지고 있다. 부모는 자녀가 자신들처럼 불안정한 단순노동에 내몰릴까 두려워하고, 자녀는 자신의 꿈을 한국에서 이룰 수 있을 것인지 불안해하고 있다.

 

인도적 체류 난민들은 더 이상 ‘임시 체류자’가 아니다. 2025년 기준, 총 2,016명 중 1,808명인 89%가 한국에서 5년 이상 살아왔고, 583명인 30%는 10년 넘게 살아온 사실상의 정주자들이다. 이들은 지역 주민, 노동자, 학부모, 학생으로서 한국 사회를 구성하며 이 시대를 함께 살아가고 있다.

 

그러나 한국 정부는 인도적 체류자의 존재를 외면하고 있다. 사회의 무관심 속에서 이들은 교육을 받을 권리, 자유롭고 안전하게 일할 권리, 가족과 함께 살 권리 등 평범한 일상을 살아갈 수 있는 권리에서 배제되어 있다. 영원히 ‘임시 비자’ 신분에 묶여, 한국에서 아무리 오래 살아도 영주권이나 귀화 자격조차 얻을 수 없다. 이 모든 조치는 인도적 체류자들에게 한국 사회의 온전한 구성원이 될 권리를 주지 않겠다는 정부의 차별적 입장을 보여준다.

 

한국 정부는 여러 차례 인도적 체류자의 지위 개선을 약속했지만, 지금까지 어떤 실질적인 조치도 취하지 않았다. 정부는 어쩌면 2,000명이 넘는 인도적 체류자들이 삶의 고단함과 불안에 지쳐 스스로 떠나기를 바라는 것은 아닌가.

 

인도적 체류자들에게는 하루, 아니 한 순간이 소중하다. 한국에서 인도적 체류자로 살아가는 시간이 길어질수록, 그들의 삶은 한국 사회의 ‘평범함’과 멀어져 간다. 우리가 요구하는 것은 거창한 것이 아니다. 보통 사람들과 같은 내일을 살아갈 수 있게 해달라는 것이다. 아이를 안전하게 키우고, 능력을 발휘할 수 있는 직업을 가지고, 가족과 함께 살고, 이 사회에서 함께한 만큼 앞으로도 살아갈 수 있는 권리를 달라는 것이다.

 

이제 더 이상 인도적 체류 난민의 존재를 외면하지 말고, 그들의 삶에 평범함을 허가하라.

Guarantee the Right to Life for Refugees with Humanitarian Status

 

“It feels like being trapped in a prison without bars.”
These were the words of a humanitarian status holder at a refugee welcoming event in 2018.
Humanitarian status refugees have been recognized under the Refugee Act as people who cannot return to their home countries. Yet in Korea, they are not guaranteed the right to live with dignity.

 

Deprived of rights that every human being ought to enjoy, their lives are marked by the denial of basic social needs and by deep uncertainty about the future. As time passes, this deprivation and uncertainty are now being passed from parents to children. Parents fear that their children will, like themselves, be forced into unstable, low-wage labor, while children worry whether their dreams can ever be realized in Korea.

 

Humanitarian status refugees are no longer “temporary residents.” As of 2025, out of a total of 2,016 people, 1,808 (89%) have lived in Korea for more than five years, and 583 (30%) have lived for more than ten years. In reality, they are settlers. They exist as neighbors, workers, parents, and students—living this era together as part of Korean society.

 

Yet the Korean government continues to turn a blind eye to their existence. Amid society’s indifference, they are excluded from the right to education, the right to safe and free labor, and the right to live with their families. Tied forever to a “temporary visa” status, they are denied permanent residency or naturalization, no matter how long they live here. These measures reveal the government’s discriminatory stance: a refusal to allow humanitarian status holders full belonging in Korean society.

 

The Korean government has repeatedly promised to improve their status, but to this day has taken no concrete action. Perhaps the government simply hopes that the more than 2,000 humanitarian status holders will grow so weary of hardship and insecurity that they will leave on their own.

 

For humanitarian status holders, every day—every moment—matters. The longer they are forced to live as humanitarian status holders in Korea, the further their lives drift from the “normality” of Korean society. What we ask for is not extraordinary. We ask only for the right to live tomorrow like ordinary people: to raise children safely, to hold jobs where we can use our abilities, to live together with our families, and to continue living in the society where we have already shared so many years.

 

No longer turn away from the existence of humanitarian status refugees. Grant them the right to live a normal life.
